Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Sobbr ("Sobbr", "we", "our", or "us") governing your access to and use of the Sobbr mobile application, the sobbr.app website, and any related services (together, the "Service"). By downloading, installing, creating an account, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and age requirement
You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater), to create an account or purchase a subscription. By using the Service you represent that you meet this requirement and that you are legally permitted to enter into these Terms in your jurisdiction.
2. The Service
Sobbr is a digital self-help tool that helps you track alcohol consumption, maintain sobriety streaks, set goals, and record reflections. The Service is provided for personal, non-commercial use only.
3. Not medical advice; health disclaimer
Sobbr is not a medical device and does not provide medical, psychological, clinical, or professional advice. The Service is not a substitute for diagnosis, treatment, therapy, or care provided by a licensed healthcare professional. Do not disregard or delay seeking professional medical advice because of anything you read in the Service.
Withdrawal from alcohol can be medically dangerous. If you experience severe withdrawal symptoms, a relapse, suicidal thoughts, or any medical or mental-health emergency, stop using the app and contact your local emergency services immediately. In the United States, you can reach the SAMHSA National Helpline at 1-800-662-HELP (4357) or dial 988 for the Suicide & Crisis Lifeline. Outside the U.S., contact the equivalent service in your country.
4. Accounts
When you create an account, you agree to:
- Provide accurate information and keep it up to date.
- Keep your credentials confidential and not share your account with others.
- Notify us promptly of any unauthorized access at support@sobbr.app.
- Take responsibility for all activity that occurs under your account.
You may delete your account at any time from Settings → Account → Delete Account inside the app, via sobbr.app/account-deletion, or by emailing support@sobbr.app. Deletion is permanent.
5. Subscriptions and in-app purchases
Some features of the Service require a paid subscription or one-time purchase. All purchases are processed by Apple through the App Store or by Google through Google Play. The price, billing period, and included features are shown to you at the point of purchase before you confirm.
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions at any time in your Apple ID or Google Play account settings; uninstalling the app does not cancel a subscription.
Refunds are handled by Apple or Google in line with their respective policies. We are not able to issue refunds directly for purchases made through the App Store or Google Play.
If we offer a free trial, the trial converts into a paid subscription at the end of the trial period unless you cancel before it ends.
6. License and acceptable use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control for your personal, non-commercial use. You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
- Copy, modify, distribute, sell, lease, or sublicense any part of the Service.
- Use the Service to violate any law or to infringe the rights of others.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related systems.
- Use automated means (bots, scrapers) to access or extract data from the Service.
- Use the Service to harass, harm, or impersonate another person, or to upload unlawful content.
- Circumvent any technical limitations, security measures, or payment systems.
7. User content
You retain ownership of the notes, goals, reflections, posts, comments, and other content you create in the Service ("User Content"). Private content (such as personal notes and goals) is kept private to your account. Community content (such as forum posts, comments, profile information, and follows) is visible to other users of the community feature as described in section 8.
You grant Sobbr a limited, worldwide, non-exclusive, royalty-free license to host, store, back up, reproduce, display, and distribute your User Content solely as needed to operate, secure, and improve the Service and the community feature. For community content, this license includes the right to display the content to other users until you remove it or delete your account.
You are responsible for your User Content and represent that you have all rights necessary to submit it and that it does not violate these Terms, our Community Guidelines, or applicable law.
8. Community feature
Sobbr includes a community feature where users can post, comment, follow each other, and interact. Your use of the community is also governed by our Community Guidelines. By posting, you agree not to share content that is harassing, hateful, illegal, sexually explicit, promotes or romanticizes substance use, encourages self-harm, contains other users' personal information, or otherwise breaks the Community Guidelines.
We provide in-app tools to report objectionable content and to block abusive users. Reports are reviewed and acted on, typically within 24 hours. We may remove content, restrict features, or suspend or terminate accounts for violations. Sobbr does not pre-screen all User Content and is not responsible for content posted by users; however, we reserve the right (but not the obligation) to remove or refuse to display any content for any lawful reason.
You are solely responsible for your interactions with other users. Do not rely on community content as professional medical advice.
9. Intellectual property
The Service, including its software, design, text, graphics, logos, and trademarks, is owned by Sobbr and protected by intellectual property laws. Except for the limited license granted to you in these Terms, no rights are transferred to you.
10. Third-party services
The Service relies on third-party platforms and providers (including Apple, Google, and our cloud hosting providers). Your use of those platforms is governed by their own terms. We are not responsible for the acts or omissions of third-party providers.
11. Apple App Store — additional terms
The following applies if you obtained the app from the Apple App Store. These Terms are between you and Sobbr, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for addressing any claims by you or any third party relating to the app, including product-liability claims, consumer-protection claims, or claims that the app fails to conform to any applicable legal or regulatory requirement. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country and that you are not listed on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the Service to you is not commercially viable. Upon termination, the license granted to you ends and we may delete your account data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and governing law) will survive.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Service will be error-free, secure, or continuously available, or that any data you record will be preserved without loss.
14. Limitation of liability
To the maximum extent permitted by law, Sobbr and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of the amount you paid us in the 12 months immediately preceding the event giving rise to the claim or 50 USD. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including, where applicable, statutory consumer rights).
15. Indemnification
You agree to indemnify and hold Sobbr harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any applicable law or the rights of a third party.
16. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Rwanda, without regard to its conflict of laws principles. The courts of Kigali, Rwanda will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing in this section deprives consumers of mandatory protections available under the laws of their country of residence.
17. Changes to these Terms
We may update these Terms from time to time. When changes are material, we will notify you through the app or by email and update the "Last updated" date above. Continued use of the Service after the effective date means you accept the revised Terms.
18. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sobbr regarding the Service. If any provision is found to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not waive that right or provision. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
